These Terms and Conditions (“Terms”) govern your access to and use of the Blood Sugar Reset course and related services (the “Course”) provided by TheDiabetiCarnivore LLC, a Texas limited liability company (“TheDiabetiCarnivore,” “Company,” “we,” “us,” or “our”).

By purchasing, accessing, or using the Course at www.thediabeticarnivore.com/blood-sugar-reset (the “Site”), you (“you,” “User,” or “Participant”) agree to be bound by these Terms. If you do not agree to these Terms, do not purchase or use the Course.

2. Eligibility

2.1 Age Requirement. The Course is intended for individuals who are at least 18 years old. If you are under 18, you may only use the Course with the consent and active supervision of a parent or legal guardian, who will be deemed the contracting party for purposes of these Terms.

2.2 Geographic Scope. The Course is primarily intended for residents of the United States, but is accessible worldwide. You are responsible for ensuring that your use of the Course complies with all laws and regulations applicable in your jurisdiction. We do not represent that the Course is appropriate or lawful in all locations; access is prohibited where the Course or these Terms are not permitted by local law.

3. Course Description & Tiers

3.1 Nature of the Course. The Course is an education-focused program designed to provide general information about nutrition, lifestyle, and blood-sugar management concepts. It is not a substitute for individualized medical care.

3.2 Available Tiers. We currently offer the following tiers (collectively, the “Services”):

Tier 1 – Self-Paced Course: Access to pre-recorded educational modules and related materials.

● Tier 2 – Course + Monthly Q&A Session: Self-paced Course plus access to approximately one live or recorded Q&A session per month (format and schedule determined by us).

● Tier 3 – Course + 1:1 Session: Self-paced Course plus one individual coaching or consultation session (date, time, and medium to be mutually coordinated).

3.3 Lifetime Access. Unless otherwise specified at checkout, your purchase includes lifetime access to the Course materials as long as the Course is offered by us. “Lifetime” refers to the lifetime of the Course, not your personal lifetime. We reserve the right to discontinue, rebrand, or replace the Course at any time.

3.4 Course Changes. We may add, modify, update, or remove content, features, modules, Q&A formats, or other components of the Course at any time, with or without notice. Such changes will not entitle you to any refund.

4. Payment, No-Refund Policy, and Chargebacks

4.1 Payment Processors. Payments are processed by third parties such as Stripe and PayPal (each, a “Payment Processor”). By making a purchase, you also agree to be bound by the applicable Payment Processor’s terms and policies.

4.2 Prices. Prices for the Course and its tiers are displayed at checkout and may be changed at any time before purchase. All fees are due in full at the time of purchase unless a payment plan is explicitly offered.

4.3 No Refund Policy. All sales are final. There are no refunds. By purchasing the Course, you acknowledge and agree that you will not be entitled to a refund for any reason, including but not limited to lack of perceived benefit, changes in your health status, or inability to participate.

4.4 Payment Plans (if applicable). If we offer a payment plan and you enroll, you agree to complete all installments. Failure to make a scheduled payment may result in suspension or termination of your access to the Course and Services until the account is brought current.

4.5 Chargebacks and Disputes. You agree not to initiate a chargeback or payment dispute with your bank or Payment Processor without first providing us an opportunity to address your concerns. If you initiate a chargeback in violation of these Terms, we reserve the right to:

● Immediately revoke your access to the Course and any related services; and

● Pursue collection of amounts owed and any associated fees, including reasonable attorneys’ fees and costs, to the maximum extent permitted by law.

5. Health & Medical Disclaimer

5.1 Educational Purposes Only. The Course and all related content (videos, PDFs, Q&A sessions, coaching, community discussions, and any other materials) are provided for educational and informational purposes only. They are not intended as, and do not constitute, medical advice, diagnosis, treatment, or a cure for any disease, condition, or health issue.

5.2 No Doctor–Patient Relationship. Your participation in the Course does not create a doctor–patient, dietitian–client, or any other licensed healthcare professional relationship between you and TheDiabetiCarnivore LLC, its owner(s), contractors, or representatives.

5.3 No Medication or Dosage Advice. We do not provide specific medication or dosage recommendations. Any discussion of general nutrition, lifestyle, insulin, or other health-related concepts is informational and not individualized medical advice. You must consult your own licensed healthcare provider regarding any changes to medications, insulin dosing, or treatment plans.

5.4 Consult Your Healthcare Provider. You should consult with your physician or other licensed healthcare provider before:

● Making any major dietary changes, including carnivore or animal-based diets;

● Adjusting your insulin or other medications;

● Initiating new exercise or lifestyle programs.

5.5 Do Not Disregard Professional Advice. Do not disregard, delay, or avoid seeking professional medical advice from your healthcare provider because of something you learn in the Course or community.

5.6 Emergencies. For medical emergencies, call your local emergency number (e.g., 911 in the U.S.) or seek immediate in-person medical care. The Course is not designed to handle medical emergencies or urgent medical situations.

6. Coaching, Personalization & Scheduling

6.1 1:1 Sessions and Q&A. Where included in your tier, live Q&A calls and 1:1 sessions may involve tailored discussions about your situation. These discussions are still educational in nature, not medical care, even if individualized.

6.2 No Clinical Services. We do not order labs, prescribe medications, manage prescriptions, or provide licensed clinical services. Any suggestions are for general educational purposes and must be reviewed with your licensed healthcare provider before implementation.

6.3 Scheduling and Expiry of Sessions.

● For tiers including 1:1 sessions, you must schedule your session within the timeframe communicated at checkout or in your welcome materials.

● If you fail to schedule or attend your session within the specified timeframe (and do not provide reasonable advance notice where applicable), the session may be forfeited without refund, at our discretion.

6.4 Rescheduling. We will make reasonable efforts to accommodate rescheduling requests made within a reasonable time frame, but we are not obligated to offer rescheduling for missed or last-minute-canceled sessions.

7. Community Access & Conduct

7.1 Facebook Group / Community. Some tiers may include access to a private online community (such as a Facebook group) or similar platform (the “Community”). Access to any Community is a privilege, not a right, and may be revoked at our discretion.

7.2 Moderation. Initially, the Community may be moderated by us. Over time, we may appoint or outsource moderation to third parties. Moderators are not providing medical or professional advice and are focused on facilitation and enforcement of community guidelines.

7.3 Community Behavior Rules. You agree that you will:

● Treat all participants with respect;

● Not harass, bully, or threaten others;

● Not post hate speech, explicit content, or illegal content;

● Not spam, solicit, or attempt to sell products/services without our prior written consent;

● Not give medical advice or attempt to act as a healthcare provider to other members.

7.4 Removal for Misconduct. We may, in our sole discretion, remove you from the Community and/or revoke Course access (temporarily or permanently) for violation of these rules or any conduct we deem disruptive, harmful, or inconsistent with the spirit of the program. Removal for misconduct does not entitle you to a refund.

8. Intellectual Property & License

8.1 Ownership. All Course content and materials, including but not limited to videos, PDFs, worksheets, text, graphics, logos, audio, and any other materials (the “Content”), are owned by or licensed to TheDiabetiCarnivore LLC and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License. Upon purchase, and subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Content solely for your personal, non-commercial use.

8.3 Prohibited Uses. You agree that you will not:

● Share, sell, or transfer your login credentials;

● Copy, reproduce, distribute, republish, upload, post, publicly display, or transmit any Content outside of the Course platform, except as expressly permitted for personal use;

● Create derivative works based on the Content;

● Use the Content to create your own competing program or services.

8.4 Enforcement. Unauthorized use of the Content may violate intellectual property laws and these Terms, and may result in termination of your access and potential legal action.

9. User Responsibilities

9.1 Personal Health Responsibility. You are solely responsible for:

● Monitoring your own health, blood sugars, and overall well-being;

● Communicating with your healthcare provider about any changes in your diet, exercise, or medications;

● Making your own decisions about whether and how to implement any educational information from the Course.

9.2 Accuracy of Information. You agree to provide accurate information about yourself when requested (e.g., for scheduling, support, or community access) and to update it as needed.

9.3 Technology Requirements. You are responsible for ensuring you have the necessary hardware, software, and internet connection to access the Course and its related services.

10. Testimonials, Marketing & Results

10.1 Testimonials. If you voluntarily submit a testimonial, review, comment, or feedback (including by email, form, video, or post in the Community), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing, promotional, and educational purposes, including using your first name, first initial of last name, and general location (e.g., “Phil S., Austin, TX”), unless you explicitly request otherwise in writing.

10.2 Individual Results Vary. Any stories, testimonials, or examples of results presented in the Course, on the Site, or in marketing materials are examples only. Your results will depend on many factors including your starting point, medical history, adherence, and coordination with your healthcare provider.

10.3 No Guarantees. We make no guarantees or warranties that you will achieve any particular outcome, including but not limited to lower A1c, weight loss, medication reduction, improved blood sugars, or any specific health result.

11. Third-Party Platforms & Tools

11.1 Course Platform (Systeme.io). The Course may be hosted or delivered through third-party platforms such as Systeme.io and other service providers. Your use of those platforms may be subject to their separate terms and policies.

11.2 Other Tools. We may use additional third-party tools for scheduling (e.g., Calendly), video calls (e.g., Zoom), email communications, or community hosting (e.g., Facebook). We are not responsible for the availability, security, or performance of these third-party services.

11.3 Third-Party Content. Any links or references to third-party websites, products, or services are provided for convenience only and do not constitute an endorsement. We are not responsible for the content or practices of third-party sites.

12. Data, Privacy & Security

12.1 Basic Data Handling. In the course of providing the Course, we may collect certain information from you, such as your name, email address, and other details you voluntarily provide. This information is used to deliver the Course, communicate with you, and manage your account.

12.2 Third-Party Storage. Your data may be stored and processed by third-party platforms (such as Systeme.io, payment processors, email service providers, and community platforms). We make reasonable efforts to choose reputable providers, but we cannot guarantee their security practices.

12.3 No Absolute Security. While we take reasonable measures to protect your information, we cannot guarantee absolute security of any data transmitted over the internet. You share information at your own risk.

13. Disclaimers, Limitation of Liability & Indemnity

13.1 General Disclaimer. To the fullest extent permitted by law, the Course and all Content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13.2 Limitation of Liability. To the maximum extent permitted by law, in no event shall TheDiabetiCarnivore LLC, its owners, members, employees, contractors, or representatives be liable for:

● Any indirect, incidental, consequential, special, or punitive damages;

● Any loss of profits, revenue, data, or goodwill;

● Any claims arising out of or related to your use of the Course, Content, or Services.

● In all cases, our total aggregate liability arising out of or related to the Course or these Terms shall not exceed the amount you paid for the Course tier giving rise to the claim.

13.3 Assumption of Risk. You understand and agree that any implementation of information from the Course is done at your own risk, and that you are responsible for coordinating with your healthcare provider regarding your health choices.

13.4 Indemnification. You agree to indemnify, defend, and hold harmless TheDiabetiCarnivore LLC and its owners, members, employees, contractors, and representatives from any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

● Your use of the Course, Content, or Services;

● Your violation of these Terms; or

● Your violation of any rights of a third party.

14. Dispute Resolution, Governing Law & Venue

14.1 Informal Resolution First. If you have any dispute or concern, you agree to first contact us at info@thediabeticarnivore.com and allow us at least thirty (30) days to attempt to resolve the matter informally.

14.2 Governing Law. These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

14.3 Venue; Arbitration.

● To the extent any dispute cannot be resolved informally, you agree that such dispute shall be resolved either in the state or federal courts located in Travis County, Texas, or, if we elect, by binding arbitration in Texas under the rules of a recognized arbitration provider.

● You consent to the personal jurisdiction of such courts and/or arbitration forums.

14.4 Class Action Waiver. To the fullest extent permitted by law, you agree that any claim you may have against us must be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative action.

15. Termination

15.1 By Us. We may suspend or terminate your access to the Course and Services at any time, without refund, if we determine that you have violated these Terms, engaged in disruptive or harmful behavior, or misused the Course or Community.

15.2 By You. You may stop using the Course at any time. However, due to the no-refund policy, cessation of use will not entitle you to any refund or credit.

15.3 Effect of Termination. Upon termination, your license to access the Course and Content immediately ceases. Sections of these Terms that by their nature should survive termination (including but not limited to payment obligations, intellectual property, disclaimers, limitations of liability, and dispute resolution) shall survive.

16. Changes to These Terms

We may update or modify these Terms from time to time. When we do, we will revise the “Last updated” date at the top. Your continued use of the Course after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Course.

16.5 Extras

THIS IS NOT MEDICAL ADVICE

The information, recommendations, and suggestions provided during our consultations, through any course material, or communicated through any medium (including but not limited to written content, audio, video, or verbal communication) are for educational purposes only. I am not a licensed medical doctor, healthcare provider, or mental health professional, and the information provided is NOT intended to replace medical advice, diagnosis, or treatment provided by a licensed healthcare provider. You should always seek the advice of your personal physician or another qualified healthcare provider for any medical condition or treatment and before starting any new healthcare regimen or making any changes to your current health routine.

WAIVER OF LIABILITY

Release of Responsibility:

By choosing to follow any of the suggestions, recommendations, or information provided by me, you expressly release, waive, discharge, and covenant not to sue me, my affiliates, employees, agents, or representatives, from any and all liability for any injuries, harm, side effects, or consequences arising out of your application of the information provided, whether in person, online, or in written form. Limitation of Liability:

17. Entire Agreement

These Terms constitute the entire agreement between you and TheDiabetiCarnivore LLC regarding the Course and Services and supersede any prior or contemporaneous communications or proposals, whether oral or written, between you and us relating to the Course.
